Legal representation refers to a situation where a lawyer handles a person’s case in the court – whether the person is the plaintiff or defendant; complainant or the Accused person.

Note however that legal representation does not stop at litigation. It goes beyond litigation and touches virtually all our transactions, family issues, relationship, businesses, etc.

In a world littered with high volume of commercial transactions, business, industrialization and online deals, the need for legal representation cannot be overemphasized. We live in a world where selfishness, greed, fraud and cheating are the order of the day. A land owner who had sold his plot of land to someone would still proceed further to sell same to one or more persons.

In contractual agreements, parties seek to breach the terms of the agreement to the detriment of the other parties. Some persons are looking for ways to cheat, defraud and take advantage of others.

Goodness of Presumption of Innocence

Some are lawless and desperadoes. They are ready to take the law into their hands at any slightest opportunity. Everyday crimes are perpetrated in every nook and cranny of the world in spite of the presence of law enforcement agents. Our prisons are filled up with criminals and innocent persons. It might come as a surprise to you that it is not every prisoner that is a criminal. Some of them are innocent of the allegations that led them to be incarcerated.

Our law is good in the sense that it presumes every person innocent until the contrary is proved by a court of law. Although on some occasions, innocent persons are convicted and sentenced to punishment of imprisonment or fine due to the evil machination of wicked persons, our law generally seeks to do justice.

Legal representation is one of the key factors for entrenchment of justice. Lawyers are experts in legal matters. They are peacemakers. They are ministers in the temple of justice and would not allow injustice to be perpetrated in and out of the court.

A lot of costly legal mistakes can be avoided. Rods can be prevented from being laid on the lot of the righteous. Criminals may not be allowed to go unpunished. Parties can be protected from being cheated, defrauded and taken advantage of. Parties injured can be compensated. People’s rights can be protected from being infringed upon.

All these are made possible through the instrumentality of legal representation. Legal representation can be costly and this has made many people to turn back from pursuing justice. But it is really perplexing that in spite of the avalanche of free legal aids available in Nigeria, many people are not aware. In the public sector, we have such agencies as the Public Complaint Commission, National Human Rights Commission, Legal Aid Council of Nigeria, etc.

In the private sector, there are many law firms that offer pro bono legal services as part of their services. There are also many NGOs and civil society organizations that offer pro bono legal services to the vulnerable and the less privileged Nigerians.

On Legal Retainership

“Retainer” means a sum of money that is paid to somebody regularly or in advance to make sure he will be available to work for the person who pays for his services.

In the legal practice, it is common to hear of individuals, businesses, companies and organizations hiring lawyers on retainer. Where the service of a lawyer is retained by a client, it means the client pays a specified sum of money to the lawyer for the services he will render to the client over a period of time, usually a year.

For those who are not conversant with the prevailing practice in the legal practice, it is worthy of note that hiring a lawyer on retainer differs from hiring a lawyer each time you need his services.

In the case of retainer, a client doesn’t have to keep paying for the services of his lawyer each time he renders services to him. Once the client pays the retainer fee, that fee covers all the services his lawyer will keep rendering to him for a whole year or of an agreed period of time.

The implication of retaining the services of a lawyer is that if within a year you have 100 legal problems, your lawyer will not charge additional fee other than the retainer fee.

But in the case where you have to hire a lawyer each time you are confronted with a legal problem, you will have to pay your lawyer 100 times if you have 100 legal problems.

Why Retainer?

“Why retainer? What if you have only one legal problem in a year or what if you don’t have any legal problem within the period of retainer, would that be advisable that you hire a lawyer on retainer?
Well, if you are sure you will have only one legal problem or none in a year, then, probably retainership is not for you.

But when you consider what it will take to pay for your lawyer’s services each time you consult him, you will understand why many prefer hiring a lawyer on retainer.

For many individuals, business persons, organizations, corporate bodies, including but not limited to banks, institutions, NGOs and even government agencies, nothing is more beneficial than legal retainer. The retainer fee that they pay to their lawyer for one year is worth the amount their lawyer will charge for a single brief he handles.

The advantage of legal retainer over hiring a lawyer to do a particular job is that legal retainer saves cost. Instead of paying your lawyer each time he renders a service to you, you pay for all services for a whole year or for a particular period agreed upon.
Thereafter, you don’t pay additional fees.

On the other hand, hiring a lawyer for a specific legal task may be preferable, if one is not likely going to need the services of a lawyer for many legal tasks. For instance, an individual who for whole year would consult a lawyer for a few solicitors’ jobs as drafting a Deed of Transfer, Letter of Demand or consultation on a particular legal issue, may dispense with the need for legal retainer.

On the whole, you will need the services of a lawyer from time to time, but whether you opt for legal retainer or hire a lawyer to handle only a particular job is your choice.
